Acceptance of terms and conditions

Access to and the use of the Lowest Quote website is subject to, and regulated by, these terms and conditions. By using the Lowest Quote website you confirm your agreement to these terms and conditions, as amended by us from time to time. If you do not accept these terms and conditions, you must not use the website.

From time to time as required these terms and conditions may be amended in whole or in part by Lowest Quote. "services" means any one or more of the services offered by Lowest Quote from time to time, being primarily the obtaining of quotes from suppliers of services on your behalf;

"you" and "your" are references to you the user of the Lowest Quote website.

General Condition

2.1

You are excluded from using the services if you are under the age of 18 years and by requesting a quote you warrant to us that you are over 18 and have capacity to enter into a legally binding contract.

Your Sole Responsibilities and Liabilities

3.1

You are solely and legally responsible for:

(a) the content of all information included in a request for a quote; and

(b) all of your communications with suppliers.

3.2

You make contact with suppliers and use their services entirely at your own risk. In particular it is your responsibility to ensure that the suppliers contacted by you are reputable and capable of providing the services for which they have provided a quote. You acknowledge that we do not provide any recommendation or endorsement in relation to suppliers who provide you with a quote.

3.3

Lowest Quote reserves the right to refuse to process your request for a quote without notice to you. Without limiting the foregoing, we may take this action if:

(a) a serious complaint or multiple complaints are received about you from suppliers;

(b) you breach these terms and conditions;

(c) you are misrepresenting yourself or the service you require; or

(d) If, in our absolute discretion, we consider your behaviour to be unacceptable.

Your duties as a user

4.1

You agree to observe all applicable laws when using the services.

4.2

You will not attempt to damage, disrupt or harm the website or the services.

4.3

You will only interface with this website manually and through a web browser. You are not permitted to programmatically or otherwise automatically interface with this website. This includes "spidering" or interfacing for the purposes of harvesting information from this website.

Disclaimer

Lowest Quote disclaims all liability to the fullest extent of the law in relation to the services. In particular users and members of Lowest Quote agree that Lowest Quote, including its subsidiaries, affiliates, officers, agents and other partners and employees:

(a) Is not responsible for any incorrect or inaccurate quotes or other information provided by or on behalf of suppliers.

(b) Is not responsible for any failure to provide the services, whether caused by users, suppliers or by any of the equipment or programming associated with or utilised by Lowest Quote.

(c) Is not responsible for the actions or omissions of any suppliers providing quotes including the negligent provision of any work carried out by suppliers for you or the failure of any supplier to honour their quote.

(d) Is not responsible for any failure of communications lines or congestion of the internet.

(e) Is not responsible for the theft or destruction or unauthorised access to, or alteration of user communications.

(f) Is not responsible for any problems or technical malfunction of any telephone network or lines, computer online systems, servers or providers computer equipment, software, on account of technical problems or traffic congestion on the internet or at any website or any combination thereof.

(g) Provides the site on an ‘as is’ basis and expressly disclaims any warranty of fitness for a particular purpose.

(h) Cannot guarantee and does not promise or warrant any specific results from the use of the website.

(i) Is not responsible for the content of advertisements appearing on the website (including hyperlinks to advertisers' own websites) and responsibility rests solely with the advertisers. The placement of such advertisements on the website does not constitute Lowest Quote’s recommendation or endorsement of the advertised product or service. While Lowest Quote will use all reasonable endeavours to correct any errors or omissions as soon as practicable once they have been brought to our attention, we do not warrant that the website will be available uninterrupted and in a fully operating condition nor that the information on and provided via the website will be free from errors or omissions.

Access to this website and its contents may be suspended temporarily and without notice in the case of system failure, necessary maintenance or repair or for reasons beyond our control.

Due to the fact that many technical aspects of the web-site and the content provided herein is supplied by or otherwise dependent on third parties, Lowest Quote does not give any warranty as to the accuracy, suitability, reliability, completeness, performance, satisfactory quality, fitness for a particular purpose, or freedom from viruses, or other harmful programs of the content contained in or accessed through this website.

To the full extent permitted by law, Lowest Quote will not be liable for any damages, including indirect or consequential losses and whether in contract, tort (including negligence) or otherwise, arising in connection with any use by you of this website.

(b) your breach of these terms and conditions or any applicable laws.

GENERAL PROVISIONS

8.1

System integrity

Lowest Quote will use its reasonable endeavours to ensure the availability of the web site and services, subject to any downtime required for maintenance. However, Lowest Quote takes no responsibility for any system unavailability, or for any loss that is incurred as a result of the website or services being unavailable. Further, Lowest Quote assumes no responsibility for the corruption of any data or information held by Lowest Quote.

8.2

Resolution of disputes

As Lowest Quote is not a party to any dispute between you and a supplier, you agree:

(a) not to involve, or attempt to involve, Lowest Quote in any dispute or in the resolution of disputes that arise between you and a supplier; and

(b) not to use the services or website to engage in or attempt to resolve the dispute with a supplier.

8.3

Exclusion of Liability for Matters Beyond our Control / Force Majeure

Lowest Quote has no liability for any lack of performance, unavailability or failure of the services of Lowest Quote or the website, or for any failure of Lowest Quote to comply with these terms and conditions where the same arises from any cause reasonably beyond the control of Lowest Quote including a force majeure event.

A force majeure event shall include, without limitation, failure of infrastructure, government intervention, wars, civil commotion, hijacking, fire, flood, accident, storm, strikes, lockouts, terrorist attacks, or industrial action affecting Lowest Quote or the suppliers.

8.4

No Waiver

If we do not exercise or enforce any right available to us under these terms and conditions, it does not constitute a waiver of those rights.

8.5

Partial Invalidity

If any of these Terms and Conditions are determined to be illegal, invalid or otherwise unenforceable by reason of law then to the extent and within the jurisdiction in which that term is illegal, invalid or unenforceable, it shall be severed and deleted from these terms and the remaining terms shall survive, remain in full force and effect and continue to be binding and enforceable.

Governing Law

These terms and conditions and your membership are governed by the laws of Western Australia and Australia. You submit to the non-exclusive jurisdiction of the Courts of Western Australia.

Intellectual Property Rights

Lowest Quote (and its licensors or suppliers, as the case may be) owns all intellectual property rights and other proprietary rights in the website (including text, graphics, logos, icons and sound recordings) and the software and other material underlying and forming part of the services and the website. You may not without our prior written permission, in any form or by any means:

(a) adapt, reproduce, copy, store, distribute, print, display, perform, publish or create derivative works from any part of the website; or

(b) commercialise, copy or on-sell any information or items obtained from any part of the website.

Entire agreement

These terms and conditions and our privacy policy supersede all previous conditions, understandings, commitments, agreements and representations whatsoever whether oral or written and constitute the entire agreement between the parties relating to the subject matter of these terms and conditions.
